The new National regulator; will be emphasising a risk management approach and a suite of documents as the VET Quality Framework. These documents will enable ASQA with very strong legal powers.
ASQA’s regulatory approach will emphasise monitoring and investigating risk, and will target those RTOs, courses and qualifications rated as higher risk. Non‐compliance may incur a range of action (including fines, suspension of registration and closure). Focusing on poor performers will allow ASQA to reduce the regulatory burden on strong, proven providers.
ASQA will continually assess risks presented by RTOs, courses, qualifications and the VET system. Our analysis will be informed by:
- the Risk Assessment Framework (s.190 of the National Vocational Education and Training Regulator Act 2011)
- structured risk assessments of intitial, renewal and scope applications
- advice from auditors
- feedback from industry regulators and associations
- student complaints
- information provided by Australian, state and territory governments, and
- analysis of non-compliance data indicators, including student and employer outcomes and visa data.
ASQA will also have a dedicated complaints team.
